2. Who We Sell To

This website sells exclusively to individual consumers purchasing for personal use. By placing an order, you confirm that you are not purchasing for resale or business purposes, and that you have the legal capacity to enter into a binding contract.

3. Our Products

Every piece in the Birta Ólafsdóttir collection is individually numbered, hand-stamped, and certificated — whether held in stock or produced to order.

For made to order pieces, please allow approximately 6–10 weeks for production before your order is ready to ship. Production timelines are estimates and may vary. Delivery time is separate and begins once your order has shipped.

Estimated transit times from dispatch are 3–5 business days for domestic shipments and 7–14 business days for international shipments. These are estimates and are not guaranteed.

Risk of loss transfers to you upon delivery to the shipping address provided at checkout. Where signature confirmation is required, responsibility transfers once the shipment is marked as delivered and signed for.

4. All Sales Final

Because every piece is individually numbered and uniquely assigned upon purchase, all sales are final. We do not accept returns or exchanges except as required by mandatory law.

If you are a consumer residing in the European Union or United Kingdom, nothing in these Terms limits any mandatory statutory rights you may have under the laws of your country of residence.

5. Damaged or Incorrect Items

If your piece arrives damaged or incorrect, please contact us promptly upon delivery at info@birtaolafsdottir.com with your order number, a description of the issue, and clear photographs of the item and packaging. Prompt notification assists us in filing carrier claims, which are subject to the carrier's own reporting deadlines. Depending on the circumstances, we may offer repair, replacement, or store credit.

6. Order Changes & Cancellations

Because production begins shortly after purchase, cancellation or modification requests must be submitted within 48 hours of purchase confirmation. After this point, your piece may already be in production and changes may not be possible. Please contact us as soon as possible at info@birtaolafsdottir.com with your order number.

We reserve the right to cancel orders at our discretion in cases of suspected fraud, pricing errors, or product unavailability.

7. International Orders & Customs

International customers are responsible for any customs duties, import taxes, and related charges applied by their local authorities. These are outside our control and are not included in the purchase price. We are not responsible for customs delays or seizures.

8. Pricing & Payment

All prices are displayed in Euro. Prices are exclusive of any applicable local taxes or duties unless otherwise stated at checkout. Payment is processed securely through Shopify. We do not store full payment details.

9. Intellectual Property

All content, designs, images, branding, and product designs on this website are protected by applicable intellectual property laws and remain the property of Birta Ólafsdóttir / LUCIE Group Sàrl. Your purchase does not transfer any intellectual property rights. Unauthorised reproduction or commercial use is prohibited.

10. Resale & Certificate of Authenticity

Each piece is issued with a Certificate of Authenticity at the time of sale. This certificate is an integral part of the work and is transferable only in conjunction with the original piece.

We do not provide authentication or warranty services for pieces acquired through secondary market transactions, third-party resellers, or auction. Any representations made by third parties regarding our pieces are made independently and without our authority.

11. Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the amount paid for the product. We are not liable for indirect, incidental, or consequential damages, or for delays caused by circumstances beyond our reasonable control.

Nothing in these Terms excludes liability for gross negligence, fraud, or any rights that cannot be excluded under mandatory law.

12. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to natural disasters, governmental action, supply chain disruptions, transport interruptions, or other circumstances we could not reasonably have anticipated or prevented.

13. Governing Law & Disputes

These Terms are governed by Swiss law. Any dispute arising in connection with these Terms or your purchase shall be subject to the jurisdiction of the courts of Canton Valais, Switzerland.

If you are a consumer residing in the European Union, you retain the right to bring proceedings before the courts of your country of residence where mandatory law requires this.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the website following any changes constitutes acceptance of the revised Terms.
